Terms of Service

Please read these terms carefully before using our appliance repair services.

These Terms of Service (“Terms”) govern your use of appliance repair services provided by Albany Appliance Repair (“we,” “us,” or “our”). By scheduling service, allowing our technicians into your home, or using our website, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

1. Service Agreement

Scope of Services

Albany Appliance Repair provides professional appliance repair services for residential and commercial customers in Albany, NY and surrounding areas. Our services include:

  • Diagnosis of appliance problems
  • Repair of major household appliances
  • Replacement of defective parts
  • Emergency refrigerator repair services
  • Warranty service on completed repairs

Service Appointment

When you schedule service with us, you agree to:

  • Provide accurate information about your appliance and the problem
  • Be available during the scheduled service window
  • Provide reasonable access to the appliance requiring service
  • Ensure a safe working environment for our technicians
  • Notify us at least 24 hours in advance if you need to reschedule

Cancellations with less than 24 hours notice may be subject to a $50 cancellation fee.

2. Diagnostic Service & Pricing

Diagnostic Fee

We charge a $75 diagnostic service call fee for all service appointments. This fee covers:

  • Technician travel to your location
  • Professional diagnosis of the appliance problem
  • Written repair estimate with parts and labor costs
  • Expert recommendations on repair vs. replacement

If you approve the repair during the same visit, the diagnostic fee is waived and applied toward your total repair cost. If you decline the repair, you pay only the diagnostic fee.

Repair Pricing

All repair prices are provided in writing before work begins. Our pricing includes:

  • Parts: Cost of replacement parts needed for the repair
  • Labor: Technician time to complete the repair
  • Taxes: Applicable state and local sales tax

The price quoted is the price you pay. We do not add hidden fees, surprise charges, or upcharges after the fact.

Price Changes

If additional problems are discovered during the repair that were not apparent during diagnosis, we will:

  • Stop work immediately
  • Explain the additional problem clearly
  • Provide a revised written estimate
  • Obtain your approval before proceeding

3. Payment Terms

Payment Due

Payment is due in full upon completion of service. We accept the following payment methods:

  • Cash
  • Credit cards (Visa, Mastercard, American Express, Discover)
  • Debit cards
  • Personal checks (with valid ID)

Payment for Declined Repairs

If you choose not to proceed with a recommended repair after diagnosis, you are responsible for payment of the $75 diagnostic fee at the time of service.

Past Due Accounts

Accounts not paid within 30 days will be subject to:

  • Late fees of 1.5% per month (18% annual percentage rate)
  • Collection agency referral after 60 days
  • Responsibility for all collection costs and legal fees

4. Warranty

Repair Warranty Coverage

All repairs performed by Albany Appliance Repair are covered by our warranty:

  • Labor Warranty: 90 days from date of service
  • Parts Warranty: 1 year from date of installation

Our warranty covers the specific repair we performed. If the same problem recurs within the warranty period due to defective parts or workmanship, we will repair it at no charge.

Warranty Exclusions

Our warranty does NOT cover:

  • New or different problems that develop after the repair
  • Damage caused by misuse, abuse, or neglect
  • Damage from power surges, lightning, or electrical issues
  • Damage from improper installation by others
  • Normal wear and tear on appliances
  • Appliances moved to a different location after service
  • Repairs performed by other technicians after our service

Manufacturer Warranties

Some parts may carry manufacturer warranties that extend beyond our warranty period. We will provide manufacturer warranty information when applicable.

To make a warranty claim, contact us at (518) 123-4567. You must provide proof of service (receipt or invoice).

5. Cancellation & Rescheduling

Customer Cancellations

  • More than 24 hours notice: No charge, full refund if prepaid
  • Less than 24 hours notice: $50 cancellation fee
  • No-show (customer not home): $75 service call fee charged

Rescheduling

We understand that schedules change. You may reschedule your appointment at no charge if you provide at least 24 hours notice.

Our Cancellations

If we need to cancel or reschedule your appointment, we will:

  • Contact you as soon as possible
  • Offer alternative dates and times
  • Prioritize rescheduling your service

We do not charge fees when we reschedule appointments.

6. Liability & Limitations

Our Responsibility

Albany Appliance Repair is fully insured with $1 million general liability coverage. We are responsible for:

  • Damage caused by our technicians during service
  • Loss or theft of property by our employees
  • Injuries caused by our negligence

Limitations of Liability

Our liability is limited to the cost of the repair performed. We are NOT responsible for:

  • Consequential Damages: Food spoilage, lost wages, hotel costs, or other indirect losses
  • Pre-Existing Damage: Problems that existed before our service
  • Appliance Age: Normal wear and failure of older appliances
  • Acts of God: Damage from storms, floods, fires, or other natural disasters
  • Third-Party Damage: Damage caused by utility companies, other service providers, or property owners

IMPORTANT: Our maximum liability for any claim shall not exceed the amount you paid for the specific repair service.

Customer Responsibility

You are responsible for:

  • Ensuring appliances are accessible for service
  • Disconnecting water lines to washers, dishwashers, and ice makers before service (if requested)
  • Securing pets during service appointments
  • Providing accurate information about appliance problems
  • Following maintenance recommendations to prevent future problems

7. Service Recommendations

Repair vs. Replace Guidance

We provide honest assessments about whether repair or replacement makes more financial sense. Our recommendations are based on:

  • Appliance age and expected remaining lifespan
  • Repair cost compared to replacement cost
  • Frequency of recent repairs
  • Availability and cost of replacement parts
  • Energy efficiency considerations

When we recommend replacement instead of repair, we do so because it serves your best interest, not ours. The final decision is always yours.

Declined Repairs

If you decline a recommended repair, you acknowledge that:

  • The appliance problem has been explained to you clearly
  • You understand the risks of continued operation
  • We are not responsible for subsequent failures or damage
  • You release us from liability for the unrepaired condition

8. Parts & Materials

Quality Parts

We use quality replacement parts that meet or exceed manufacturer specifications. Parts may be OEM (Original Equipment Manufacturer) or high-quality aftermarket parts.

Parts Availability

Common parts are stocked on our service vehicles for same-day repairs. Less common parts may need to be ordered, typically arriving within 1-3 business days. We will inform you of any parts delays before proceeding with the repair.

Old Parts

Defective parts removed during service become our property unless you specifically request them at the time of service. We may be required to return warranty parts to manufacturers.

9. Safety & Access

Safe Working Environment

You agree to provide a safe working environment for our technicians, including:

  • Clear access to appliances requiring service
  • Adequate lighting in work areas
  • Secure pets during service visits
  • Disclosure of known hazards (mold, asbestos, structural issues)

Hazardous Conditions

Our technicians reserve the right to refuse service or leave immediately if they encounter:

  • Unsafe electrical conditions
  • Gas leaks or carbon monoxide
  • Structural hazards
  • Aggressive animals
  • Threatening or hostile behavior
  • Illegal activity

If service is refused due to unsafe conditions, you are still responsible for payment of the diagnostic fee.

10. Dispute Resolution

Communication First

If you are dissatisfied with our service, please contact us immediately at (518) 123-4567. We are committed to resolving issues quickly and fairly.

Mediation

If we cannot resolve a dispute through direct communication, both parties agree to attempt mediation before pursuing legal action.

Governing Law

These Terms are governed by the laws of the State of New York. Any legal disputes will be resolved in the courts of Albany County, New York.

Limitation on Legal Action

Any legal action related to our services must be filed within one (1) year of the date of service. Claims filed after this period are barred.

11. Additional Terms

Entire Agreement

These Terms, along with any service invoices and estimates, constitute the entire agreement between you and Albany Appliance Repair. No verbal promises or agreements that contradict these Terms are binding.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

Assignment

You may not transfer or assign your rights under these Terms without our written consent. We may assign these Terms to a successor business entity.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new “Last Updated” date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
